Asylregler i Ungarn som pålegger potensielle asylsøkere til landet å rette en foreløpig søknad til ungarske utenriks­stasjoner, er i strid med EU-retten, fastslår en kjennelse fra EU-domstolen i Luxembourg torsdag.

Den aktuelle loven, som Ungarn innførte under koronapandemien i 2020, pålegger asylsøkere – ukrainske krigsflyktninger ikke medregnet – å henvende seg til Ungarns ambassader i land som Serbia og Ukraina, og dette har i praksis redusert asylinnvandringen til Ungarn til et minimum, skriver Politico.

Men i henhold til EU-dommerne har asylsøkere rett til å be om asyl på den ungarske grensen.

In their ruling on Thursday, EU judges wrote that the law amounts to “a disproportionate interference with the right of those persons to make an application for international protection upon their arrival at a Hungarian border.”

The court also argued that Hungary had violated the bloc’s international protection rules, which do not allow an individual to leave an EU country to file an asylum application abroad. Those EU rules, the ECJ argued, ensure “effective, easy and rapid access to the procedure for granting international protection.”

EU-domstolens kjennelser i asylpolitikken strider mot den nasjonale suvereniteten, mener Ungarns statsminister Viktor Orbán.

“We regret that the Court has made such a decision, but we also regret that the European Commission and the Court of Justice of the European Union have forced us to create this legislation in the first place,” said Gergely Gulyás, Hungary’s minister of the Prime Minister’s Office, in response to the ECJ ruling.

Det er ikke første gang unionsdomstolen erklærer at Ungarns asylpolitikk er i strid med EU-retten:

The ECJ already shot down another component of Hungary’s migration practices in May 2020, ruling that the country had unlawfully detained asylum seekers at its border with Serbia.
