23-åringen som i fjor ble pågrepet i Bulgaria og utlevert til Norge, ble mandag tiltalt for å ha oppfordret til å begå terrorhandlinger og for å ha deltatt i al-Qaida.

Ifølge tiltalen kom han i perioden juni 2021 til 31. mai 2022 med gjentatte oppfordringer til terror gjennom å publisere syv magasiner på nett.

Far er dømt for æresvold, nå er to sønner siktet og tiltalt for terror

Den omfattende tiltalen på ni sider viser til «oppfordringer til å begå terror, religiøse tekster som legitimerer bruk av vold, og brukerveiledninger til å begå terrorhandlinger.»

Grunnlag:
I perioden juni 2021 til 31. mai 2022 i Norge og Bulgaria med blant andre brukernavnene TaghutSlayer, Hurras Al-Tawheed og Abu Yahya, benyttet han flere digitale kommunikasjonsplattformer til offentlig å publiserer oppfordringer til å begå terrorhandlinger. Han bidro til å publisere syv magasiner med navnet O MUJAHIDEEN IN THE WEST. Magasinene inneholdt oppfordringer til å begå terror, religiøse tekster som legitimerer bruk av vold, og brukerveiledninger til å begå terrorhandlinger.

Oppfordringene til å begå terrorhandlinger ble blant annet publisert slik:

11. juni 2021 delte han en følgende melding på ChirpWire:

«O my beloved fighters around the world.

I will teach you how to make weapons, which you can use against the mushrikeen (feiltroende). Gas, bombs, how to stab, etc.

But I will pick few, only those who know and truly wants to fight for the sake of Allah. So take contact, and we can move, if Allah has given us permission. (send me a private message)

As it is a duty for every single fighter to fight for the sake of Allah. You either fight where you are, or migrate to the land of Tawheed (monetistenes land)

But before i teach you, all of you should search the hukm of jihad. Do not go and fight for the sake of Allah, if you do not have any knowledge of the fiqh (islamsk rettslære om) surrounding jihad.

By Allah, you will never earn the title as a «shaheed» (martyr) if you go around with no knowledge and start shooting and killing.
Have knowledge and be smart in your move.
be creative in your warfare.

And how many groups in the name of Islam has killed unnecessarily and unjustly?

«There are more brothers from Al-Qaeda going to kashmir and India.

I highly advice you to search for the group under the banner of Al-Qaeda or «Ghazwatul hind» (a group associated with Taliban).

But a group is not needed to fight. You and together with other brothers should attack the mushrikeen at the best of your ability and take their wealth in any way to progress in your jihad against the kuffar.

Go especially after those with weapons, as you can take their weapons and use them to further continue your battle. And I Ask Allah to Aid those who fight for His sake, and Grant martyrdom to those who have sincere intention.

«Urgent call to establish Tawheed O ummah of Muhammed (saw)

– I tidsrommet 10. til 15. februar 2022 publiserte han på GNews og magasinet O MUJAHEDEEN IN THE WEST nr. 1 som blant annet inneholdt budskap om at «Jihad» er den mest forsømte religiøse plikt for muslimer» og en oppfordring om å «Attack them from within!»

– 22. februar 2022 publiserte han på GNews og magasinet O MUJAHEDEEN IN THE WEST nr. 2 som blant annet inneholdt budskap om angrep i Kaukasus-regionen i Russland og en oppfordring til å begå soloterrorisme rettet mot «vantro».

– 23. februar 2022 publiserte han på ChirpWire en lenke til et nettsted som inneholdt 21 filer med Al Qaidas Inspire Magazine og et oversiktsdokument med oppfordring til å lese alt av det vedlagte materialet, samt å følge vurderingene til de lærde og plikten til jihad.

There are spies here, thinking they can monitor and get us. Woe to you O enemy of Allah, if you do not repent now, than it will be too late once the sword of the mujahideen reaches your neck. – I tidsrommet 13. til 16. mars 2022 publiserte han via GNews og ChirpWire magasinet O MUJAHEDEEN IN THE WEST nr. 3 som blant annet inneholdt oppfordring om terrorangrep rettet mot ambassader, rettsbygninger og sikkerhetssteder, ledsaget av en artikkel om hvordan å bygge en bombe med «Solid Ox«.

– 20. mars 2022 publiserte han via GNews og ChirpWire magasinet O MUJAHEDEEN IN THE WEST nr. 4. Det inneholdt blant annet et budskap til muslimske hyklere om at de også vil bli knust av de troende i den pågående krigen mellom Islam og vesten, samt en artikkel som oppfordret til enighet mellom AlQaida og ISILs tilhengere, slik at man i felleskap kan «enjoy the execution of the Zionists» og «rather we should strive together, united under the banner of Tawheed and slaughter the invaders.» Magasinet inneholdt også brukerveiledninger for å lage napalm og lynkurs i drap og knivangrep.

– 30. mars 2022 publiserte han i rollen som talspersonen Abu Yahya for Hurras Al-Tawheed via ChirpWire og GNews et flyveblad med overskriften «Victory Or Martyrdom«:

«All praise is due to Allah alone, may the peace and blessings of Allah be upon our beloved Nabi, the last messenger of Allah.

– 31. mars 2022 publiserte han via GNews og ChirpWire magasinet O MUJAHEDEEN IN THE WEST nr. 5. Det inneholdt blant annet et budskap til muslimer som av en eller annen grunn ikke har klart å flytte fra Vesten, til å begå terrorhandlinger i Vesten («Dar-ul Kufr«), samt artikler som oppfordrer til å angripe fengsler i hele verden og drepe hver eneste fangevokter, for å frigjøre fengslede og undertrykte muslimer i alle land. Magasinet inneholdt også artikler om datasikkerhet for å unngå anklager om terrorisme og produksjon av nitroglyserin.

– 2. april 2022 publiserte han via GNews og ChirpWire magasinet O MUJAHEDEEN IN THE WEST – Ramadan Edition. Det inneholdt blant annet en artikkel der forfatteren oppfordret muslimer til å begå terror i USA og Vesten. Magasinet inneholdt også sitater fra kjente ledere i Al-Qaida illustrert med et bilde fra terroraksjonen mot New York i 2001 (911- angrepet) og redaksjonell tekst om jihad som en religiøs forpliktelse til å angripe de «vantro».

– 1. mai 2022 publiserte han via GNews og ChirpWire magasinet O MUJAHEDEEN IN THE WEST nr. 6. Det inneholdt blant annet religiøse sitater og avgjørelser som legitimerer terror mot sivile «vantro», også kvinner og barn. Det inneholdt også oppfordring og legitimering av gift, kjemiske og biologiske våpen til bruk ved terrorhandlinger.

– 6. mai 2022 publiserte han på ChirpWire en lenke til et nettsted som inneholdt 21 filer med Al Qaidas Inspire Magazine og et oversiktsdokument med oppfordring til å lese alt av det vedlagte materialet, samt å følge vurderingene til de lærde og plikten til jihad:

– 31. mai 2022 laget han eller medvirket til å lage magasinet O MUJAHEDEEN IN THE WEST nr. 7. Det inneholdt blant annet en oppfordring til å ta livet av seks navngitte og avbildede personer. Magasinet inneholdt artikler om bruk av
brannstiftelse i kampen mot de «vantro», ledsaget av brukerveiledninger for «enkel flammekaster». Magasinet lå ferdigprodusert på hans pc, men det ble ikke delt offentlig fordi han ble pågrepet av politiet.

Budskapet var enkeltvis og samlet offentlige oppfordringer til å be gå en eller flere terrorhandlinger.

Al-Qaida og pakistansk Taliban (TTP) er listeført av FNs sikkerhetsråd som terrororganisasjoner og har begått en rekke krigsforbrytelser og terrorhandlinger som drap, ulovlige frihetsberøvelser og tortur.

II Straffeloven § 136 a, jf §5

for å ha dannet, deltatt i, rekruttert medlemmer eller ytet økonomisk eller annen materiell støtte til en terrororganisasjon, da organisasjonen har tatt skritt for å realisere formålet med ulovlige midler.

Grunnlag:
I tidsrom og på steder som beskrevet i post I, deltok han i terrororganisasjonen Al-Qaida. Deltagelsen bestod i at han med de brukernavn og via de digitale plattformer som beskrevet i post I, blant annet:

– Laget og medvirket han til å lage de magasiner som er beskrevet i post I, der magasinene blant annet inneholdt artikler om hvordan å tilegne seg voldelig kapasitet:

– Hvordan lage eksplosiver

– Hvordan lage napalm
– Hvordan lage røykbomber
– Hvordan lage tåregass

Magasinene ble publisert via ChirpWire og GNews som beskrevet i post I.

30. oktober 2021 opprettet han på Telegram grupperingen Hurras Al-Tawheed. Gruppen fungerte som støtte til terrororganisasjonen Al-Qaida, og opplyste at den blant annet skulle være et samlingspunkt for vestlige mujahedin, gi oppfordringer til soloangrep mot Vesten, gi oppskrifter på ulike angrepsmidler, og begrunnelser for og legitimering av jihad fra islamske lærde. Gruppen etablerte sin egen medieavdeling under navnet Al-Bidayah, som 23. mars 2022 ble annonsert med egen logo, et videoklipp sammen med en kunngjøring fra Hurras Al-Tawheeds talsperson Abu Yahya.

– Han formidlet ved bruk av digitale plattformer som Telegram, ChirpWire og GNews, Al-Qaidas budskap i en form som var egnet til å rekruttere unge mennesker til terrororganisasjonen, herunder samlet og delte han tidligere utgitte
utgaver av Al-Qaidas magasin «Inspire» sammen med en egen leseveiledning til Inspires manualer for hvordan begå terror med enkle midler for å skape frykt i Vesten.

– Gjennom Hurras Al-Tawheeds kanaler på ChirpNews og GNews bidro han til å publisere terrororganisasjonen TTPs (pakistansk Taliban) budskap om blant annet drap og gjennomførte terroraksjoner i Pakistan i april 2022.

– Han forherliget terrorhandlinger gjentatte ganger ved offentlig å hylle tidligere gjennomførte terrorangrep.

– Han omtalte offentlig al-Qaidas grunnlegger Osama bin-Laden som «vår leder» og manet til samling av ISIL og Al Qaida, og han understreket gjentatte ganger offentlig at væpnet kamp mot vestlige land og vestlig sivilbefolkning er en personlig religiøs plikt.

Al-Qaida og pakistansk Taliban (TTP) er listeført av FNs sikkerhetsråd som terrororganisasjoner og har begått en rekke krigsforbrytelser og terrorhandlinger som drap, ulovlige frihetsberøvelser og tortur.

Straffeloven § 79 bokstav a kommer til anvendelse.
Forholdene i post I og post II er begått i utlandet og straffeloven § 5 kommer til anvendelse.
